Eviction Process in San Jose

Evictions in California are complex and heavily favor tenants. San Jose landlords must follow strict legal procedures or risk having cases dismissed—or worse, facing tenant lawsuits.

This guide outlines the eviction process, timelines, and best practices to protect your rights as a property owner in Silicon Valley.

Important Warning

Self-help evictions (changing locks, removing tenant belongings, shutting off utilities) are illegal in California and can result in significant penalties. Always follow the legal process.

California Eviction Timeline

1

Serve Notice (Day 1-3)

Depending on the reason, serve the appropriate notice:

  • 3-Day Notice to Pay or Quit – for non-payment of rent
  • 30-Day Notice to Quit – for month-to-month tenancies (less than 1 year)
  • 60-Day Notice to Quit – for tenancies over 1 year
  • 3-Day Notice to Cure or Quit – for lease violations
2

File Unlawful Detainer (Day 4+)

If tenant doesn't comply, file an unlawful detainer lawsuit at the Santa Clara County Superior Court. Filing fee: approximately $435.

3

Serve Summons (Day 5)

The tenant must be served with the summons and complaint by a process server. They have 5 days to respond.

4

Court Hearing (Day 15-30)

If tenant contests, a hearing will be scheduled. If tenant doesn't respond, you can request a default judgment.

5

Writ of Possession (Day 20-45)

If you win, the court issues a writ of possession. The sheriff schedules the eviction (typically 5-10 days after the writ is issued).
